Maryland Residential Landlord Tenant Code
A breakdown of tenant protections, security deposit laws, and landlord covenants.
Landlord Obligations
Maryland law mandates that the landlord is covenant-bound to keep the leased property habitable, clean, and safe:
- Must keep all structural integrity (roofs, walls, floors, doors) weatherproof and functional.
- Must resolve high-priority electrical, plumbing, or heating issues within critical response timelines.
- Must declare proper security deposit safety accounts.
Tenant Responsibilities
Tenants are legally obligated to care for the community and properties during their active lease terms:
- Pay all lease rent payments on or before the designated monthly transfer date.
- Sustain cleanliness, preventing sanitation degradation or garbage accumulation.
- Notify Bousa Properties of on-call repairs or leaks immediately to avoid secondary damage.
Security Deposit Rules in Maryland
A landlord cannot charge more than the equivalent of two months’ rent as a security deposit. The landlord must provide the tenant with a written receipt and must keep deposits in an interest-bearing escrow account. The deposit, with interest, must be returned to the tenant within 45 days after the end of the tenancy, minus any legal deductions withheld for damages beyond normal wear and tear.
